Insurance

Skeudva holds professional liability insurance with AXA Assurances IARD Mutuelle, 313 Terrasses de l’Arche, 92727 Nanterre Cedex, under policy no. RCPAXA278632079, taken out through Orus France SAS, 14 avenue du Général de Gaulle, 94160 Saint-Mandé (ORIAS registration no. 26000343).

The cover applies to damage occurring in France. It is extended worldwide for business trips of less than three months: trade shows, fairs, sales or study assignments.

Purpose and scope

These general terms and conditions of sale (T&Cs) govern, without restriction or reservation, all sales concluded on the analoggwerz.com website between SKEUDVA (“the seller”, “we”) and any consumer customer (“the customer”, “you”).

Any order implies full and complete acceptance of the T&Cs in force on the day of the order, which the customer acknowledges having read before confirming their purchase. They can be consulted at any time on this page and take precedence over any other document. The seller reserves the right to amend them. The T&Cs applicable to an order are those online at the time it is confirmed.

Products

The shop sells second-hand photographic and video equipment (film and digital cameras, lenses, camcorders and accessories), as well as consumables (film in particular).

Unless otherwise stated, each item is a unique piece and only one is available, with no restocking. The photographs on product pages are contractually binding as they show, without retouching, the very item being sold, flaws included.

The condition of each item is described using the terms set out on the page conditions and guarantees. The checks carried out before an item goes on sale are described on the page our testing method. The customer acknowledges that they are buying second-hand equipment whose appearance and operation match the description on the product page, which also states, where applicable, any points not tested or any defects found.

Price

Prices are stated in euros, including all taxes. Second-hand goods may be subject to the VAT margin scheme (article 297 A of the French General Tax Code, CGI): in that case, VAT is not shown separately on the invoice and cannot be reclaimed.

Delivery costs are shown to the customer before the order is confirmed and are added to the price of the items. Delivery is free from €150 of purchases in mainland France. For other destinations, the exact rate is shown before the order is confirmed.

The applicable price is the one displayed on the day of the order. In the event of an obvious pricing error (a price that is derisory compared with the actual value), the seller may cancel the order and refund the customer in full.

Orders

The ordering process consists of: adding items to the basket, checking the summary (items, prices, delivery costs), entering delivery and billing details, then payment. The order is only final once payment has been confirmed. A confirmation email setting out the full order is sent to the customer.

As the stock consists of one-off items, if an item turns out to be unavailable after the order has been placed (stock error, damage found during preparation), the seller will inform the customer immediately and refund the corresponding amount in full, without undue delay.

The seller reserves the right to refuse an order for any legitimate reason, in particular in the event of a previous dispute or a serious suspicion of fraud.

Payment

The price is payable in full, in a single payment, on the day the order is placed. The accepted payment methods are those offered at checkout on the website. Transactions are processed by a secure payment provider: the seller never has access to full bank card details.

Items remain the property of SKEUDVA until the price has been paid in full. In accordance with the law, risk passes to the customer when the customer (or a third party designated by the customer) takes physical possession of the goods.

Delivery

Orders are delivered to the address given by the customer, by tracked parcel. The destinations served and their rates are shown at the delivery step, before the order is confirmed. Each camera is packed with particular care, suited to the fragility of older equipment.

Under Article L. 216-1 of the French Consumer Code (Code de la consommation), delivery takes place no later than 30 days after the order is confirmed. In practice, orders are shipped within a few working days. If this deadline is exceeded, the customer may require the seller to deliver within a reasonable additional period and, failing that, cancel the order. The customer is then refunded all sums paid, within 14 days at the latest.

If a parcel is visibly damaged on receipt, the customer is advised to note reservations with the carrier and to let us know as soon as possible at contact@analoggwerz.com, with photos: we will take it from there.

An error in the address provided by the customer may result in the parcel being returned. Sending it out again may be charged at the current delivery rate.

Right of withdrawal

The customer has 14 days from receipt of the order to exercise the right of withdrawal, without having to give any reason (Articles L. 221-18 et seq. of the French Consumer Code).

To exercise it, simply notify us of your decision before the period expires, by an unequivocal statement (an email to contact@analoggwerz.com is enough) or by using the model form reproduced in the appendix to these terms.

The goods must be returned to us no later than 14 days after this notification, complete (with any accessories, cases and manuals supplied) and in packaging that protects them. Return costs are borne by the customer.

The refund covers all sums paid, including the initial delivery charges (at the standard rate), and is made no later than 14 days after the goods are recovered or proof of their dispatch is received. It is made using the payment method used for the order.

You may handle the camera as you would have done in a shop in order to examine it. However, any depreciation resulting from handling beyond what is necessary to establish its nature and functioning may be deducted from the refund.

Legal guarantees

Regardless of the right of withdrawal, all our items are covered by the legal guarantees, including as second-hand goods : the legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). Claiming under them is free of charge: simply write to us at contact@analoggwerz.com.

These guarantees are the ones the law grants to every buyer: they do not constitute an additional commercial guarantee on our part.

As the stock consists of one-off items, an identical replacement is usually impossible: in that case, the customer may obtain a repair where possible, a price reduction or cancellation of the sale with a full refund, under the conditions provided by law.

Customer service and complaints

For any question or complaint, there is a single address: contact@analoggwerz.com. We acknowledge receipt and first look for an amicable solution: it is almost always the quickest, and it has been how we work since our very first sale.

Consumer mediation

If our exchange does not lead to a solution, you can use a consumer mediator free of charge. In accordance with Articles L. 612-1 et seq. of the French Consumer Code, Skeudva is a member of the CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice) :

A case can only be referred to the mediator after a written complaint sent directly to contact@analoggwerz.com that has not received a satisfactory response, and within one year of that complaint.

Personal data

The data collected when an order is placed is necessary to process it (preparation, shipping, invoicing, accounting obligations) and is processed in accordance with the privacy policy available on the website. In particular, the customer has the right to access, rectify and erase their data, which they can exercise by writing to contact@analoggwerz.com.

Intellectual property

All content on the analoggwerz.com website (text, photographs, logos, layout) is protected by intellectual property law and remains the property of SKEUDVA or its partners. Any reproduction or distribution, in whole or in part, without prior written permission is prohibited.

Governing law

These terms and conditions of sale are drawn up in French and governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts will have jurisdiction under the ordinary rules, without prejudice to the protective provisions applicable to consumers in their country of habitual residence.

If any clause of these terms is declared void, the other clauses will remain fully valid.

Appendix: model withdrawal form

Only use this if you wish to withdraw (a simple email clearly stating your decision works just as well).
